A Raven’s Battle-Cry: The Limits of Judgment in the Medieval Irish Legal Tract Anfuigell by Charlene M. Eska
Requirements: .PDF reader, 1 MB
Overview: In A Raven’s Battle-cry Charlene M. Eska presents a critical edition and translation of the previously unpublished medieval Irish legal tract Anfuigell.
‘A raven’s battle-cry is a misuse of judgments’. Thus begins the medieval Irish legal text Anfuigell ‘Wrong Judgment’ or ‘Non-judgment’, a collection of legal judgments on a variety of topics ranging from the property rights of widows to selling stolen goods to shipwrecks and beyond. The text and accompanying commentary is extant in five main fragments found in three different manuscripts now housed in the libraries of Trinity College, Dublin, and the Bodleian Library in Oxford, with smaller fragments extant in manuscripts in the British Library and Royal Irish Academy Library. Although the text itself is not complete, when one takes into account the legal commentary and glosses on individual words and phrases accompanying the text, Anfuigell and its associated legal material amount to one of the larger bodies of legal matter in the corpus of attested medieval Irish law. This legal tract has never been edited or accurately translated and, as such, it constitutes a legal mystery box for scholars.
